Rochester, MN (KROC AM News) -  A group of Rochester neighbors is suing the city in an effort to prevent a proposing housing project from going forward.

The City Council recently approved a zone change for the project, known as Legacy on Fourteenth. It consists of two lots on the north side of 6th Street and on the west side of 14th Ave. SW.

The council’s vote came after it heard from several neighbors who spoke against the proposal, which was denied by the city Planning and Zoning Commission. Six of those neighbors who voiced opposition have filed the lawsuit.

Among the claims in the filing, they contend the zone change needed for the project amounted to “illegal spot zoning. ” They also claim the council’s action was a violation of the city’s zoning ordinance.

The lawsuit says the project would “cause great and irreparable injury to Plaintiffs including the degradation of a traditional, established single-family residential neighborhood, increased density, parking, traffic, crowding, congestion, and the resultant deleterious effects on their own property values.”

A court hearing on the lawsuit has been scheduled to be held in October.
