Rochester Man Gets 65-Month Sentence in Plea Agreement
Rochester, MN (KROC-AM News) - A plea agreement covering a lengthy list of criminal charges has resulted in a more than five-year prison sentence for a Rochester man.
Plea Agreement Dismisses Multiple Felony Charges
According to Olmsted County court records, 39-year-old Brandon Gene Gergen has entered guilty pleas to felony counts of DWI, receiving stolen property and violating a no-contact order. He also admitted to a gross misdemeanor theft charge in exchange for the dismissal of a list of felony charges that included multiple counts of third-degree burglary, felony assault and felony theft.
Rochester Man Receives 65-Month Prison Sentence
His sentencing order says Gergen was given concurrent prison terms totaling 65 months, with credit for the 139 days he has already spent in jail. According to his plea agreement, Gergen also agreed to pay more than $4,000 in restitution.

Court Documents Detail Other E-Bike Theft Allegations
Court documents indicate most of the restitution is tied to the theft of an e-bike from a southwest Rochester apartment complex in August. In that case, the criminal complaint says a surveillance camera recorded video of Gergen and a woman following a vehicle into the locked parking garage and then leaving on e-bikes.

He had also been accused of two other e-bike thefts this past summer. One of the thefts occurred in a secure downtown Rochester Mayo Clinic parking ramp in August, and the other was reported at St. Mary's Hospital in June.
