An Olmsted County jury could not reach a verdict in his recent trial and a mistrial was declared by District Court Judge Joseph Chase. He then ordered the two sides back for Thursday’s hearing.

Olmsted County Attorney Mark Ostrem could proceed with the same charge, amend the criminal complaint or file for a dismissal.

Ostrem feels he and his staff made the right decision when the 2nd-degree murder charge was filed last year after Weiss shot and killed 17-year-old Muhammed Rahim during a verbal confrontation that followed a minor traffic mishap.

Defense attorney James McGeeney said Wednesday he has not had a recent conversation with Ostrem and is not sure what will happen next.
