says he'll try to get the youth released on bail and put into his father's care.

Attorney Bernard Brown said Tuesday that he will also seek a competency hearing for the boy, who is charged as an adult with criminal homicide.

Brown says the boy may have mental health issues. He says those issues could indicate he is not competent to stand trial and also may support his case being transferred to juvenile court.

Authorities say the boy was visiting his grandfather, the woman's caretaker, on Saturday when the woman shouted at the child for entering her room. They say he held a cane to Helen Novak's throat before he punched her in the throat numerous times.
