Man Charged in Rochester Christmas Day Murder Deemed Competent for Trial

Back in May, an Olmsted County Judge ordered a psychological evaluation for 39-year-old Mustafa Bush to determine if he is competent to stand trial. Bush is charged with two counts of second-degree murder and a drug possession charge in connection with the shooting death of 41-year-old Kimberly Robinson last Christmas. 

The proceedings in the case were ordered to continue during a hearing in Olmsted County Court Friday morning. The next court date in the case had not been scheduled as of Friday afternoon. 

The attorney representing Bush also filed a motion asking the judge to suppress two pieces of evidence in the case, arguing they were obtained through overbearing search warrants. The judge has not yet ruled on the motion. 

The criminal complaint accuses Bush of fatally shooting Robinson then leaving her body in a ditch along a rural northwest Rochester. Her body was found by a woman walking her dog the day after Christmas. 

The court document says investigators learned that Robinson had been living with Bush in a southeast Rochester residence for about two years and was last seen alive with Bush in the early morning hours of Christmas Day. A family member later told investigators that Bush had confided in her that he had hurt his girlfriend.

Another witness told police that Bush had a large suitcase in the front area of his vehicle that was too heavy to move. The individual indicated he saw the large piece of luggage when he offered to help Bush free his vehicle from deep snow late Christmas night. The criminal complaint says blood evidence was later found in Bush's vehicle, along with about a half pound of cocaine.

Bush served a prison sentence after he was convicted of murder in Olmsted County in 2007. He was discharged from prison in 2020 when he was placed on supervised release.
