The criminal complaint, filed in Olmsted County Court on Monday, says the arrest occurred shortly before 11:30 p.m. on October 13, 2022.
The court document says the Rochester Police Department responded to the report of an impaired driver in the parking lot of an unnamed apartment complex in southwest Rochester.

Police found the suspect vehicle occupied by a man, later identified as 31-year-old John Joseph Stucki, sitting in the driver’s seat.
The Bricelyn man was seen naked inside of the vehicle, making rapid movements and drawing quick and shallow breaths, the charges say.
Officers saw the locked vehicle’s keys in the center council. The complaint says Stucki refused the officer's commands to unlock the doors and exit the vehicle.
Police broke out the vehicle’s passenger window and removed Stucki. He then spat on one of the officers who was placing him on a cot with safety restraints, the court filing alleges.
Police obtained a search warrant to draw a sample of Stucki’s blood and submit it for testing. The test detected the presence of amphetamine and methamphetamine in his blood, the charges say.
Stucki has been charged with a felony count of Fourth-Degree Assault of a Police Officer and a gross misdemeanor DWI Controlled Substance charge.
Court records indicate the October 2022 incident occurred just over six months after a DWI conviction in Dakota County that stemmed from a 2019 encounter with law enforcement.
Stucki is due to make his first appearance in Olmsted County Court next month.
