Rochester, MN (KROC-AM News)- A Rochester man is facing a felony assault charge for an incident at a local restaurant.

The criminal complaint, filed in Olmsted County Court on Monday, says the alleged assault occurred early Friday evening. 

The victim in the case is an employee at the restaurant where the incident occurred. The court document also alleges the assailant sent the victim a threatening text message. 

Rochester Man Accused of Assaulting Restaurant Employee With Water Bottle

40-year-old David Deangelo Colon is charged with third-degree assault and gross misdemeanor DWI. Rochester police officers responding to the scene encountered the victim bleeding from the face, the court document states. 

A review of surveillance camera footage shows Colon entering the business and throwing a water bottle at the victim, who was working a shift behind the counter. Colon is then seen raising his fists to the victim, the complaint states.

The victim is shown punching Colon, causing him to go down, the complaint says. The footage shows the victim attempting to help Colon up but Colon kept trying to punch the victim.

Eventually the victim got Colon out of the restaurant, the court document says. The restaurant is not named in the complaint. 

The victim suffered “significant disfiguring laceration on his face” and had cuts on his hand that were deep enough to show bone, the charges say. 

Alleged Assailant Suspected of Driving Drunk

When speaking with Colon, officers smelled the odor of an alcoholic beverage and noticed he had blood shot, watery eyes and slurred speech. The complaint says. 

Police learned from Colon and witnesses that he had driven to the restaurant and initiated a DWI investigation based on that information. The court document also says Colon was too injured to engage in field sobriety testing and that he refused to take a breath test. 

Colon was released without bail following his first court appearance on Monday. He is due back in court in April.
