Rochester, MN (KROC-AM News)- A Rochester man charged in connection to a gun incident at a Rochester bar has avoided prison time.

The incident happened last September. Rochester Police responded to the report of an intoxicated man seen with a handgun before passing out in his vehicle. 

The call originated from the North Star Bar in the 500 block of Broadway Ave. North. Upon arrival police found the subject, identified as 33-year-old Johnathan Terrell, in his vehicle with the gun and a small amount of cocaine. 


Terrell was charged with the following crimes

  • Felony count of second-degree assault
  • Felony fifth-degree drug possession
  • Gross misdemeanor count of reckless use of a dangerous weapon 
  • Gross misdemeanor of carrying a pistol without a permit 
  • Misdemeanor for possessing a firearm while intoxicated 

On Wednesday Terrell entered into a plea agreement that calls for him to admit to the reckless use of a weapon charge. In exchange the prosecution has dropped the other charges related to the gun incident.

The agreement also settles a separate DWI case against Terrell that opened earlier this year. He pleaded guilty to a misdemeanor DWI charge to settle that case. 

The plea deal orders Terrell to serve one year of probation. It also included a 65-day jail sentence that he's been given credit for already serving in the Olmsted County Jail. 

Terrell was also sentenced to 70 hours of community service, per court records.
