
Rochester Man Sentenced in Restaurant Assault Case
Rochester, MN (KROC-AM News) - A Rochester man accused of assaulting an employee of a local restaurant earlier this year has been sentenced to two years of probation.
Felony Assault Charge Dismissed
Olmsted County court documents indicate that 40-year-old David Deangelo Colon entered into a plea agreement this week and admitted to misdemeanor assault and DWI charges. A felony count of third-degree assault was dismissed as part of the plea agreement.

Restaurant Employee Suffered Significant Facial Injuries
According to the criminal complaint against Colon, he was arrested in late February after Rochester police responded to the restaurant and found the employee bleeding from injuries to his face. The court document states that the victim had a "significant disfiguring laceration on his face" and cuts on his hand that were deep enough to expose bone.
The victim told officers that Colon entered the restaurant and struck him in the face without provocation. The victim also showed officers threatening text messages that Colon had allegedly sent him prior to the attack.

Surveillance Video Captured Altercation
The criminal complaint says a review of surveillance camera footage showed Colon entering the restaurant and throwing a water bottle at the victim while he was standing behind the counter. The video then shows Colon raising his fists toward the victim, who responded by punching Colon, causing him to fall to the floor.
The video then shows the victim attempting to help Colon get up, but Colon continued trying to punch the restaurant employee. Eventually, the victim was able to remove Colon from the business.

Witnesses Reported Child Was in Vehicle
The charging document also states that witnesses reported Colon had driven to the restaurant with his 11-year-old child in the vehicle. When officers spoke with him, they noticed a strong odor of alcohol and other signs of possible intoxication, but Colon refused to submit to a preliminary breath test.
