Rochester, MN (KROC-AM News)- Prosecutors have brought charges as the result of an investigation into a reported fight and mace spraying incident at this year’s Olmsted County Fair.

Olmsted County Sheriff’s Office Captain Tim Parkin previously said deputies on site responded to the altercation around 10 p.m. on July 26. 

The preliminary report indicated an altercation involving members of a group appeared to have spilled over into a parking lot and at one point an adult female involved in the altercation deployed a canister of what was described as mace or bear spray causing the crowd to disperse.

Crews from the Rochester Fire Department and Mayo Clinic Ambulance Service responded to treat several individuals who were caught in the wake of the spray. About an hour after the incident, a deputy was dispatched to meet with a woman, identified as 18-year-old Heavenly Unique‐Leosha Davis of Rochester, who reported being assaulted at the fair.

The criminal complaint says Davis told the deputy was confronted by a group of people after she got off a ride and said they chased her into the parking lot where a woman attempted to spray her.

The charges say a review of security footage captured that night shows footage of a woman, who investigators identified as Davis when they noticed the woman on video was wearing the same clothing as Davis, chasing after a group of people while holding an object.

She is then seen raising the object and using it to spray the group. An off-duty Olmsted County Detention Deputy attending the fair with his family reported seeing a woman in the same clothing as Davis holding a canister above her head and deploying spray into the air, the charges say. 

Davis was charged Thursday with one count of gross-misdemeanor third-degree riot and a misdemeanor count of using tear gas not in an act of self-defense. She’s due to make her first court appearance on October 12.
