Charges Filed In Deadly Downtown Rochester Shooting

Rochester, MN (KROC AM News) - The charges against the man accused of a deadly shooting in downtown Rochester last weekend indicates he was released from federal prison in December and was on supervised release after serving a 65 month sentence for a weapons charge.

The criminal complaint against 28-year-old Derrick Days charges the South Saint Paul man with three counts of second-degree murder and one count of illegal possession of a firearm in connection with the shooting near the corner of 1st Avenue and 3rd Street around 2:30 Sunday morning during which two men were shot.

28-year-old Todd Banks died from his wounds, while the other man was critically wounded. His name has not been released. The complaint says both men were shot several times.

The court records say a Rochester Police Officer on routine patrol saw a man with a gun shooting in the direction of some people outside the city parking ramp at the downtown intersection. The officer chased the man and apprehended him in a nearby alley after seeing him stretch his arm over a trash receptacle where investigators later recovered a handgun behind the trash container. He was identified as 22-year-old Nautica Cox of Minneapolis, who is charged with aiding and abetting second-degree and a weapons charge.

The criminal complaint indicates investigators soon learned there had been two shooters and reviewed surveillance video from various cameras in downtown Rochester. The images show a group of people playing dice when a fight broke out. The video then shows Days pulling out a handgun and firing at the critically wounded victim at close range. He is then seen approaching Banks as he was engaged in a struggle with another man and firing multiple bullets at the victim while he was on the sidewalk.

A police investigator recognized Days as a person he had previously encountered during a drug investigation. Using additional surveillance from an apartment building, the investigator was able to identify Days as a person in the passenger seat of a vehicle seen leaving the apartment complex and apprehended him following a high-risk stop.

During his arraignment Tuesday morning, his bail was set at $2,000,000.
