Man Accused of Attack on Olmsted County Deputy Faces New Charge

Rochester, MN (KROC-AM News) - The Olmsted County Attorney's Office has upgraded the charges against a Rochester man accused of an attack on a detention deputy.

Court documents say 28-year-old Dylan Cantrell Bathke allegedly assaulted the correctional officer in the Olmsted County Adult Detention Center on the afternoon of July 29. The criminal complaint says he asked the detention deputy for a piece of scratch paper and then allegedly punched her in the face when she opened the door to his cell.

The court document describes how the punch caused the deputy to fall backward and hit her face on a guard rail before she fell to the floor. Bathke then allegedly kicked the side of her head while she was down.

According to the charges, the deputy suffered visible injuries on her head and face and reported losing consciousness and vision during the assault.

Bathke was originally charged with one count of third-degree assault and one count of fourth-degree assault of a corrections officer. Both charges are felonies. An amended complaint has now been filed in the case and adds a charge of first-degree assault involving great bodily harm against a correction employee.

Court records indicate the alleged assault in the jail occurred the day before Bathke was sentenced to 30 months in prison for convictions stemming from a robbery and three domestic assault cases. According to the Minnesota Department of Corrections, he is currently an inmate at the Stillwater State Prison and is expected to be released in late January of next year.

Bathke is scheduled to return to Olmsted County for a pre-trial hearing next month.
