Rochester Man Charged With Felony DWI For Second Time in 4 Months
Rochester, MN (KROC-AM News)- The Olmsted County Attorney's Office has charged a Rochester man convicted of criminal vehicular operation with Felony DWI.
The charges filed against 26-year-old Jacob Janet accuse him of operating a vehicle under the influence of alcohol in southeast Rochester. He was apprehended by the Olmsted County Sheriff’s Office Saturday evening.
The criminal complaint says a deputy was dispatched to the report of a domestic argument shortly before 6:30 p.m. The responding deputy met with the complainant and saw a vehicle driven by Janet leave the area of the call with its rear tail lights off.
The deputy stopped the vehicle in the area of 37th Ave. and Wildwood Ln. Southeast and saw a bottle of vodka behind the passenger seat in plain view. The deputy also said Janet was displaying signs of impairment, according to the complaint.
A preliminary breath test conducted at the scene indicated Janet had a blood-alcohol-concentration of .286, over three times the legal limit. Deputies arrested Janet and brought him to the Olmsted County Adult Detention Center where a DMT test revealed a blood-alcohol level of 0.3, the charges say.
It’s the second time this year the 26-year-old has been charged with felony DWI. Janet is set to go to trial for a felony DWI charge in May 2023 as a result of an August traffic stop in Chatfield, according to court documents.
Court records indicate Janet was convicted of felony criminal vehicular operation in 2017 after crashing his vehicle while under the influence of alcohol in High Forest Township in June of 2016. A passenger in the vehicle Janet was driving was injured in the crash.
He was arraigned on a count of felony first-degree DWI for the December traffic stop in Olmsted County Court Tuesday. His bail was set at $200,000.
