Shooting During Assault in Rochester Home With 8-Year-Old Girl Present Sends Rochester Man to Prison
In March, 46-year-old Clifford Marquis Hankins pleaded guilty to illegal possession of a firearm by a person convicted of a crime of violence in exchange for the dismissal of a second-degree assault charge.
The complaint says Hankins had arrived at a home in southwest Rochester with a gun, assaulted his brother with the weapon, and that caused the firearm to discharge on December 2.
Rochester police responded to the shooting and were told Hankins appeared to have been drinking and was highly agitated when he got into an argument with his sibling.
Hankins was accused of pulling a black pistol out of his pocket and striking his brother behind his right ear and on the bridge of his nose with a gun. The gun discharged as the victim fell backwards, the complaint says.
Responding officers found what appeared to be a bullet hole a few inches above the middle of the couch in the living room of the home. An 8-year-old girl was in the home at the time of the shooting and assault, the charges say.
Hankins fled the home but police found and arrested him in a vehicle parked at a home in northwest Rochester. Law enforcement searched the residence and found a Glock 48 pistol in an attic area of the garage.
Hankins was convicted of felony drug possession in Illinois in 2011 and was prohibited from possessing firearms and/or ammunition, according to court records.
On Monday Hankins was sentenced to 60 months in prison. He has been given credit for 183 days already spent behind bars.
