Rochester, MN (KROC-AM News)- An Olmsted County Judge has denied a motion to dismiss a disorderly conduct case that involved racial slurs being directed at a child in a Rochester park.

The dismissal motion argued the state lacked probable cause to support disorderly conduct charges filed against 37-year-old Shiloh Marie Hendrix

“The state has given a sufficient basis for which a reasonable trier of fact may find in favor of the state. Therefore, there is sufficient probable cause for both charges to move forward to trial,” the judge’s order says.

The misdemeanor charges stem from a viral video depicting Hendrix being confronted for allegedly directing a racist slur at a young child and then repeating the slur multiple times at the person recording the video.

The incident occurred in April of 2025 at the Roy Sutherland Playground in Soldiers Field Memorial Park. 

An 8-year-old boy, described in the criminal complaint as “profoundly and visibly autistic,” had taken an applesauce pouch from a diaper bag belonging to Hendricks. 

The child’s father and Hendricks chased after the boy, who had climbed onto a piece of playground equipment. Hendricks then repeatedly called the child a racial slur and snatched the applesauce from the child’s hand, the charges allege. 

A man who witnessed the encounter then began recording video and confronted Hendrix, who is seen on the video using the same slur against the man with the cell phone. 

Trial Set to Start This Summer

Hendrix was initially charged with three counts of disorderly conduct, however one of the counts was dropped in an amended criminal complaint filed in March.

The trial was originally scheduled to be held in April but was pushed back to July. Pre-trial proceedings are scheduled to begin on July 14.
