30-year-old Mohamad Kasim Rustem is charged with one count of third-degree criminal sexual conduct and one count of fifth-degree criminal sexual conduct.
The complaint says the victim spoke with police at a hospital on the night of August 29. She reported meeting Rustem through Tinder and said the two agreed to meet in Rochester to get to know each other.
The victim and Rustem met at an unnamed hotel in southwest Rochester, went to dinner then returned to the hotel, according to the court document. Rustem raped the victim when the two returned to the hotel after dinner, the charges allege.

She told police she told Rustem “no” numerous times and tried to push him off of her, the complaint says.
Investigators identified Rustem as the alleged assailant by reviewing payment records and camera footage from the restaurant.
Police arrested Rustem at his place of employment on Tuesday. Rustem told officer he and the victim had sex and claimed she had said yes to him in a “nervous way,” the complaint says.
Court records indicate Rustem was sentenced to five years probation in January of 2023 after being convicted of two counts of possession of child pornography in a 2022 case in Olmsted County.
Conditional bail for Rustem was set at $75,000 following his first court appearance Friday. He’s due back in court later this month.
