Rochester, MN (KROC-AM News) - A Rochester man has been sentenced to a year in jail and 10 years on probation for his conviction on charges stemming from a domestic incident last summer that involved the death of a dog.

32-year-old Octavio Nique was also given a stayed 18-month prison sentence and was given credit for 149 days he has already spent in jail. He earlier pleaded guilty to a second-degree burglary charge along with a felony count of animal mistreatment. The plea deal also included guilty pleas to gross misdemeanor and misdemeanor domestic abuse and harassment charges.

Nique was arrested after Rochester police were sent to a home in northwest Rochester on the morning of July 7th to investigate after a neighbor noticed the front door to the house was open. The responding officers spotted the pit bull mix floating in the four-foot deep above ground swimming pool on the property. There was also extensive damage found inside the home.
