Rochester, MN (KROC-AM News)- A man seen with a gun has been charged in connection with a fight that happened outside of a Rochester restaurant almost one year ago.

That’s according to a criminal complaint filed in Olmsted County Court on Wednesday. The incident was captured on camera and sent the alleged gunman to the hospital. 

The court document says Rochester police responded to the report of an assault on the morning of St. Patrick’s Day, 2024.

Gunman Knocked Unconscious by Victim Charged in Rochester, MN Assault Case

Officers reviewed security camera footage from Los Jarritos Café in northwest Rochester that captured the alleged assault in a nearby parking lot. 

The footage showed an individual, later identified as 48-year-old Aintario Larone Moses of Rochester, walk towards a vehicle where the victim and two other men were. The three are then seen getting into an altercation, the charges say.

Moses is shown on camera pointing a gun at the victim, before putting it away then walking away. The footage then shows the victim punching Moses in the face, knocking him to the ground. 

Responding officers arrested the victim at the scene. The man told police Moses had wracked the slide of the gun then put it back in his pocket, the complaint says.

In a follow-up interview with police, the victim said Moses demanded the victim give him money before producing the firearm, the charges say. 

The victim was subsequently charged with felony third-degree assault and misdemeanor disorderly conduct. In January, the Olmsted County Attorney’s Office dropped the case against the victim, citing “evidentiary issues,” according to Olmsted County Court records.

Moses was taken to St. Mary’s Hospital following the incident was unable to immediately speak with officers, the complaint says. 

The next day he told police he could not recall the events from the previous night, that he did not own a gun and that he did not remember where he got the gun from, according to the court document. 

A witness at the scene told officers Moses threatened the victim with the gun and that the victim knocked Moses unconscious after landing the punch, the charges say.

Moses is charged with one count of second-degree assault, terroristic threats and possession of a firearm as a person convicted of a violent crime. 

Court records indicate Moses was convicted of first-degree drug sales in January of 2004. He’s due to make his first court appearance in June.
