The Founding Fathers and framers of the U.S. Constitution expressed mixed feelings about the court system. Some believed the checks and balance system would balance judicial power. Others feared the possibility of a “runaway judiciary.” American Thinker columnist Steva McCann cited dissenters.

Alexander Hamilton thought the judicial system would be contained by executive law enforcement authority and legislative control of finances. Robert Yates thought differently, stating, “There is no power (above the courts) to control their decisions.” Thomas Jefferson, IN 1820, wrote, “Our judges and their power are dangerous as they are in office for life.”

McCann brings these concerns to contemporary times, referring to “the judicial debacle relative to the Executive Orders and actions by President Trump…”that the Federal District and Appellate Court Judges, with the blessings of the Supreme Court, would substitute their will or political opinions for the text of the Constitution or statutes…establishing an uncontrolled oligarchy resulting in political chaos as future presidents would either ignore or acquiesce to their rulings.”

McCann says Chief Justice Roberts “and the Supreme Court have given the green light to 856 District and Appellate judges to determine if all self-declared refugees must be granted asylum…and can remain in the country regardless of national security considerations…(becoming) the sole arbitrators for immigration policy for legal or illegal immigrants (and) refugees.”

Among the counter actions and remedies McCann suggests including “curtailing judicial review for the lower courts Congress created, redrawing district and circuit court boundaries, refusing to enforce edicts, and cutting off funding for enforcement.”

Columnist Patricia McCarthy writes that the Deep State “and Democrat appointed judges” are doing everything they can to keep President Trump from doing what he was elected to do.” McCarthy credits FBI Director Kash Patel and Attorney General Pam Bondi for trying to hold these “activist, partisan judges” accountable.

New York Post columnist Miranda Devine writes how President Trump “is fighting a cartel of vile, corrupt, far-left judges trying to kill his campaign promises.”

Devine chronicled several of the lawsuits, injunctions, and judges that blocked DOGE measures and fund cancellations “that were “Democrat slush funds,” and cited White House press secretary Karoline Leavitt’s quote:”92% of those injunctions have been from Democrat appointed judges trying to oppose or slow down his agenda.”

Powerline’s John Hinderaker writes that Trump is “under non-stop attack” for allegedly disobeying the orders of district judges, which Trump, in his view, has not done. Hinderaker then cited rogue judges who have violated the law, including a former New Mexico judge under arrest for hiding a wanted illegal alien in his home. And Wisconsin Milwaukee County Judge Hannah Dugan, arrested and charged with felonies for allowing a wanted illegal alien to “escape from her court room so he could escape apprehension by ICE agents who were waiting in the corridor outside the courtroom.” The agents captured the subject after a case outside.

In referring to alleged Republican culprits, Democrats often declare “No One is Above the Law. Attorney General Pam Bondi says Judges aren’t, either, when they aid illegal aliens who commit serious crimes. Jim Hoft (Gateway Pundit) quoted Bondi’s reaction to the rogue judges: “The Trump administration will fight for victims. The rule of law is very simple. It does not matter what line of work you are in. If you break the law, we will follow the facts and we will prosecute you.”

Western Journal columnist C. Douglas Golden quoted Immigration and Customs (ICE) Director Tom Homan’s reaction to the arrest of judges: “Nobody should be surprised. These actions are felonies.”

“No one is above the law.” Not even politicized judges.
