Austin, MN (KROC-AM News) - An Austin teenager was formally arraigned on murder charges in adult court today.

Sixteen-year-old Philip Tyrek Gills was previously charged as a juvenile, but he was certified to stand trial as an adult earlier this week. His conditional bail has been set at $1 million.

According to a criminal complaint filed in Mower County Court, Gills is accused of fatally shooting one man and wounding another on the afternoon of February 15 in Austin. The deceased victim, 27-year-old Opoka James Nathanael, was found shot to death in the driver’s seat of his vehicle, while a passenger managed to escape after being shot twice and was taken to St. Marys Hospital for treatment.

The charges state that a witness reported hearing gunshots and saw a black male, wearing a tan hoodie and black pants, exit from the back passenger seat and run away. The court document says three other witnesses helped officers track a suspect to a home about six blocks from the crime scene.

A search warrant was executed at the residence, and the criminal complaint says investigators found clothing matching the descriptions provided by the witnesses inside a washing machine. Another juvenile living in the home told investigators that Gills had been involved in a heated phone conversation earlier in the day before he left.

The court document says the juvenile witness stated that Gills was sweating and breathing heavily, as if he had been running, when he returned to the residence approximately five minutes after the deadly shooting was reported. The witness also told police that Gills changed his clothing after returning.

Gills is charged with second-degree murder and second-degree attempted murder. His next court appearance is scheduled early next month.
