Rochester, MN (KROC-AM News)- A Rochester man has avoided a prison sentence after being convictied of a child pornograpy crime.

He settled the case through a plea deal with prosecutors last November and was sentenced in Olmsted County Court on Monday. 

The criminal complaint in the case says law enforcement was made aware suspected child sexual abuse material through a cyber tip that was sent  to the Rochester Police Department in December of 2020.

The court document says Facebook alerted police to a video of suspected child pornography being uploaded and shared to a message. 

Investigators traced the Facebook account to the Rochester home of 41-year-old Alberto Negrete Gonzalez

Police seized Gonzalez’s phone in January of 2021 and discovered a video depicting a man and 3-7 year-old girl engaging in a sexual act, the charges say. 

The phone’s information matched the information obtained by police after they received the cyber tip from Facebook, according to the complaint.

Gonzalez was charged in April of 2022 with a count of dissemination of child pornography and a count of possession of child pornography.

The November 2023 plea agreements called for Gonzalez to plead guilty to the possession count in exchange for the dismissal of the dissemination account. 

Gonzalez was sentenced to five years of supervised probation. If he abides by the terms of his punishment, the felony child pornography possession conviction will be downgraded to a misdemeanor crime, court records say.
