Rochester, MN (KROC-AM News) - A Stewartville man jailed for allegedly assaulting an Olmsted County Deputy last fall is now accused of an assault on a Detention Deputy in the Olmsted County Adult Detention Center.

28-year-old Andrew Fogan was charged last fall with a felony count of fourth-degree assault of a peace officer following his arrest along Highway 52 near Oronoco. He was accused of striking a deputy in the face while allegedly flailing his arms and throwing punches as he resisted arrest.

The criminal complaint says the incident occurred after the deputy executed a traffic stop around 12:30 AM on September 20, 2023. The court document says a Taser was used to get Fogan under control. The deputy suffered a swollen lip and pain as a result of the incident.

The new criminal complaint against Fogan stems from an incident in the Olmsted County jail on April 12. The charge alleges a detention deputy was retrieving a meal tray from Fogan's cell when the Stewartville man allegedly threw a milk container filled with urine at the deputy.

The court document says the urine splashed on the deputy and a witness,
hitting their arms and clothing. The criminal complaint indicates the urine soaked through the deputy's pant leg and her uniform shirt and vest.

The charge says the deputy's supervisor then came to her assistance and observed the milk carton along with small puddles of a yellow liquid and a "strong odor" of urine. Fogan claimed that he threw apple juice.

He now faces another felony count of fourth-degree assault on a correctional employee. Fogan is scheduled to make his first court appearance on the new charge in late May. He is also scheduled to appear for pre-trial hearing in the first case next week.
