Rochester police arrested the man at the scene of an alleged gun threat on the morning of St. Patrick’s Day 2024. A security camera at the nearby Los Jarritos Café in northwest Rochester captured the incident.
The man accused of wielding a gun was charged in Olmsted County Court on Wednesday.

The footage shows a man, later identified as 48-year-old Aintario Larone Moses, walking towards a vehicle where 27-year-old Xavier Abreu-Vasques and two other men were. The three are then seen getting into an altercation, court documents say.
Moses is shown on camera pointing a gun at the victim, before putting it away then walking away. The footage then shows the victim punching Moses in the face, knocking him to the ground.
Moses was taken to St. Mary’s Hospital and was initially unable to give a statement to law enforcement. Police arrested Abreu-Vasques after he admitted to punching Moses, court documents say.
Abreu-Vasques was charged with felony third-degree assault and misdemeanor disorderly conduct. Olmsted County Court records indicate the prosecution threw out the case last month due to “evidentiary issues.”
